Terms of Service

Welcome to VitaGratiae. These Terms of Service govern access to and use of the VitaGratiae website, services, features, and content. VitaGratiae is owned and operated personally by Desmynd Costin in New York, United States; it is not a separate LLC or corporation. By accessing or using VitaGratiae, you agree to these Terms.

1. VitaGratiae

VitaGratiae is a digital fashion and footwear platform featuring shoe designs, fashion imagery, editorial content, voting and discovery features, and related digital experiences. Some fashion images, shoe concepts, models, characters, descriptions, and videos may be created or enhanced using artificial intelligence.

AI-generated or conceptual footwear is not proof that a physical product is available for purchase. An actual product or retailer will be specifically identified when applicable. The current design catalog presents inspiration, not products offered for sale.

2. Eligibility and acceptable use

Use VitaGratiae only for lawful purposes and in accordance with these Terms. You must not interfere with the service or its security, gain unauthorized access, scrape abusively or disrupt operations, manipulate voting or rankings fraudulently, impersonate another person, or violate applicable law or third-party rights.

3. Voting and interactive features

You may vote on shoe designs and use available interactive features. Votes and rankings may inform entertainment, research, merchandising, and content planning. They do not guarantee that a design will be produced or offered for sale. VitaGratiae may use reasonable measures to prevent abuse and manipulation, including rate limits and limits on repeat ballots.

4. AI-generated and editorial content

VitaGratiae uses AI-assisted creative production and editorial review. Unless specifically identified otherwise, people, models, scenes, and products appearing in AI-generated editorial content may be fictional or digitally generated. Sofia is an AI-assisted fashion character. Such imagery is creative editorial material, not documentary photography of real people or events.

Descriptions of appearance and styling are editorial interpretations. Unless expressly verified, they do not establish a product's actual materials, dimensions, fit, comfort, safety, or availability.

5. Third-party products and links

VitaGratiae may link to retailers, products, social-media services, and other third parties. Their own terms and privacy practices apply. VitaGratiae is not responsible for their availability, pricing, transactions, services, or content. VitaGratiae may receive compensation through commercial or affiliate relationships in the future and will provide disclosures where required.

6. TikTok sharing

VitaGratiae may provide an optional feature allowing an authorized user to send selected video content to TikTok using TikTok's official services. The proposed draft-upload integration is under development and is not currently available for production use.

When this draft-upload feature is enabled, the authorized operator selects an eligible, approved video and explicitly chooses Share to TikTok. Delivery to TikTok does not automatically publish the video. The authorized TikTok user opens the TikTok inbox notification and controls whether to review, edit, and ultimately press Post in TikTok. A Delivered status means draft delivery, not publication.

TikTok use is also governed by its own terms, policies, and privacy practices. Users may disconnect TikTok access where supported, including through TikTok's account controls. Disconnecting access does not itself remove content already delivered to or posted on TikTok.

7. Intellectual property

VitaGratiae's original branding, site content, software, graphics, compilations, and related materials are protected to the extent provided by applicable intellectual property law. Third-party intellectual property remains owned by its respective owners. Using VitaGratiae does not transfer ownership of these materials or grant rights beyond those permitted by these Terms or applicable law.

8. Availability and changes

VitaGratiae may add, change, suspend, or discontinue features. We do not guarantee uninterrupted availability, continuous compatibility with third-party services, or that every feature will always be available.

9. Disclaimer

To the extent permitted by law, VitaGratiae is provided "as is" and "as available," without warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Fashion, footwear, rankings, voting, AI imagery, and editorial materials are primarily informational, creative, discovery, and entertainment content.

10. Limitation of liability

To the maximum extent permitted by applicable law, Desmynd Costin, operating VitaGratiae, will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or loss of profits, revenue, data, or goodwill arising from use of, or inability to use, VitaGratiae, even if advised of their possibility.

Nothing in these Terms excludes or limits liability, remedies, or consumer rights that cannot lawfully be excluded or limited. Where a limitation is not permitted, liability is limited only to the extent the law allows.

11. Termination and misuse

VitaGratiae may restrict access when reasonably necessary to protect the service, users, or third parties, respond to misuse, or comply with law.

12. Governing law

These Terms are governed by the laws of New York, United States, without displacing mandatory protections that apply to you under applicable law.

13. Changes to these Terms

We may update these Terms as the service or applicable requirements change. The effective or updated date will reflect material changes. Please review the current Terms when using the service.
